Important questions to ask your Solicitor (Part 1)

Conveyancing transactions may appear complicated to the novice especially if this is the first time that you are involved with either a purchase or sale of a property. In order to get a better understanding of how the procedure works and to direct the right questions your conveyancing solicitor have a look at the questions listed below and typical answers you can expect to receive.
Your conveyancing transaction will either arise because you want to buy or sell a property. If you are buying a property with a mortgage advance then your bank or building society may have recommended a firm of conveyancing solicitors to assist with the purchase transaction alternatively if you have viewed an advertised property the estate agent may also recommend a solicitor to you, it is not compulsory for you to accept the conveyancing solicitor recommended to you however there may be some additional benefit in doing so for example a discount on solicitors costs, remember there is no obligation for you to choose a recommended solicitor.
Your choice of solicitor may be influenced by certain factors for example solicitors costs, the experience of the firm, the location of the firm and these matters will ultimately decide which solicitor carries out your conveyancing transaction. If you receive a fee quote from a solicitor always confirm the details of each item quoted and establish whether the fee quoted represents a fixed quote or a minimum of what you can expect to be charged. Also if you are buying with the aid of a mortgage confirm whether the solicitor is on the bank/building society's panel. The location of your solicitor should not pose a problem as most conveyancing solicitors can communicate with your by email, post and telephone regardless of your location. You will also always get a feel for the level of experience from your solicitor after you have spoken to them over the phone or better still if you pay them a visit at their office to enquire about their service.
If you are purchasing a property and have accepted an offer on a property the estate agent which forward the memorandum of sale to your nominated solicitor they will then contact the seller's solicitor or the seller's solicitor will immediately forward the draft documentation to them. Once you receive the copies of the documentation from your conveyancing solicitor you might want to ask them the following questions:
Likely timescale for the transaction to complete
If a specific solicitor or caseworker has been assigned to your transaction then ask if the solicitor has a preferred mode of communication, some solicitors respond promptly to emails while other solicitors regularly take telephone calls or at least return messages.
Asking your conveyancing solicitor the right questions at the appropriate time right from the outset of your transaction will ensure you understand the conveyancing process and that you are prepared for any uncertainties that may occur during the transaction.
