- If an estimated value of the estate was used to calculate the filing fee, you may be entitled to a refund after the estate value has been officially determined. If the filing fee paid is more than the corrected filing fee, you are eligible for a refund of the difference, pursuant to Title 7, Rule 7.552 (b), according to the Judicial Council of California.
- If you voluntarily dismiss a petition for probate in California within 90 days after filing and before a decision by the probate court, you may be eligible for a refund of some filing fees. However, the estate is must be valued at less than $250,000, pursuant to Title 7, Rule 7.552 (d).
- If the total value of the estate is less than the administrative fees, the estate is considered insolvent. You may be allowed a fee reduction, pursuant to Title 7, Rule 7.552 (2).
