Utah Statute of Limitations on Crimes

    No Statute of Limitations

    • There is no statute of limitations for a murder, manslaughter or capital felony. There is no statute of limitations for violent felonies if DNA evidence is collected and would identify the perpetrator at a later date. There is also no statute of limitations on child abuse homicide, aggravated kidnapping or child kidnapping.

    Sexual Crimes

    • The statute of limitations for sexual abuse of a child, rape or sodomy is within four years of the reporting of the offense.

    Other Crimes

    • The statute of limitations for felonies other than capital felonies, or for negligent homicide, is four years. For fraud or breach of fiduciary obligation, the statute of limitations is three years. For misuse of public money, bribery or falsification or alteration of public records, the maximum statute of limitations is two years from the time the information is reported to the prosecutor.
