Partial Unemployment Laws in Delaware

    Partially Employed Individuals

    • A Partially Employed Individual is one who works less than his normal full-time hours due to lack of work. If an Employer has offered less than four full days' work (or the equivalent), the Employer can file for UC-115, the Notice of Partial Employment, with the nearest office of the Delaware Department of Labor. Any affected Employees should be notified at this point that they have the right to file a claim.

    Filing a Partial Unemployment Claim in Delaware

    • The Partially Employed Individual must go to an office of the Delaware Department of Labor to file a UC-101, the Initial Claim of Benefits. If there is a date set for a return to full-time work, it must be noted. The Claimant may also elect to have all federal taxes withheld at the time of filing.

    Claiming Weekly Partial Unemployment Benefits

    • The Partially Unemployed Individual will receive a letter of approval from the Department of Labor with the weekly benefit amount she is entitled to, based on the information filed by both the Employer and the Partially Unemployed Individual. A Weekly Pay Authorization Claim must be filed every week in order to receive benefit checks. This may be filed in person, or by phone via TeleBenefits.

    What is TeleBenefits?

    • TeleBenefits is an automated phone system for filing the Weekly Pay Authorization. Eligible claimants will be provided with a brochure detailing the service in their Unemployment packet. Through the automated system, the claimant provides his personal identification (Social Security Number), Employer, and amount paid for the claim week. A check is generally mailed out the next day.
