The Consumer Protection Act, 1986 was enacted with an intention to keep the consumer rights intact. The act stands to prevent the Buyer-Seller preposition from any incidence of unfair trade practice and consumer right violations. The government has established quasi-judicial bodies at district, state and national level to make sure that justice reaches the far end of the society. Consumer Forum Bangalore is one such entity that makes sure that the residents of Bangalore are able to take a valid stand on their grievance. The NCDRC €National Consumer Disputes Redressal Commission' empowers the consumer forum to provide judgment up to a filed compensation of Rs 20 Lakhs against a court fee of just Rs 500/-. In major cases the compensation comes under Rs 100,000/- for a court fee of just Rs 100/-. This is pretty much unlike to the present state of civil litigation in India which boasts of huge costs and unending delays.
For his grievance, the consumer needs to first place a written complaint to the consumer forum through a proper representation. The attending clerk will assign a proper registration number to the complaint and will inform the near date of admission hearing. On the very date of admission hearing the complainant will be asked to present the case along with all the evidential support. Subject to the merit of case the complaint will be duly acknowledged and a notice will be issued to the opposite party. The notice will serve the purpose of intimation of hearing date and demand explanation from the respondent on the grievance. The opposite party is required to answer the notice back in the next 30 days period. On the date of hearing both the complainant and the respondent are allowed to present their case. The forum will subsequently pass an order or judgment invariably within 15 days of final hearing. The consumer court also makes provision for the consumer to go on and pursue the case at the state commission and subsequently to national commission in case of any dissatisfaction over the present judgement. Post judgment, the consumer forum can ask the manufacturer / producer to:-
1. Compensate for any financial loss on account of the defection in product or service
2. Make replacement of the defected product
3. Repair the defection in the product
4. Compensate for the costs on litigation and mental harassment
5. Bring back the stocks of defected product from the market
6. Make amendments to the marketing communication
Consumer Forum Bangalore provides an aggrieved consumer a platform where his grievances are given a patient hearing and based on the gravity of the complaint the manufacturer / producer is asked for a rightful compensation. Going beyond the inefficiencies of the civil court, the consumer forum makes it possible for an average consumer to avail justice in a smaller time frame and at a lesser cost. The documentation has also been kept very simple for the consumers without bringing any complexities to the litigation.
