- 1). Travel to the Louisiana state district court where the probate case was previously pending. Speak with the court clerk to determine whether the case is indeed closed. Ask the clerk if there are any local forms required to reopen a probate case. If there is a form, take one from the clerk.
- 2). Fill out the Petition to Reopen Probate Case form. Generally, you will need to provide your name, the name of the probate case and the explanation for your request to reopen the case. If no petition is available, seek the advice of a Louisiana probate attorney. Drafting your own petition will, however, essentially involve stating why the probate must be reopened, such as that property of the deceased has been found.
- 3). File the petition to reopen the probate case with the court clerk. You may have to serve copies of your petition on certain interested parties, such as the probate estate administrator. Seek the advice of an attorney regarding service of the petition. If the court chooses, it may set a hearing on the petition, depending upon the procedure of your particular court. If a hearing takes place, attend the hearing to argue your position to the judge.
