In the state of Kentucky, the Revised Statutes contain laws governing the regulation and administration of businesses within the state. The statutes contain titles containing laws that apply to specific business, such as laws relating to hotel businesses and laws relating to finance company businesses. The statutes also contain laws which relate to company formation. - Chapter 306 of the Kentucky Revised Statutes contains details relating to proprietors of hotel businesses. Section 30 of this chapter explains the liability of hotel businesses towards guests, in cases where a guest's property is lost or damaged. If a guest's property is not lost or damaged as a result of negligence on the part of the hotel owner, or the hotel's employees, the hotel owner is not liable for more than $100. If a commercial traveler suffers loss or damage to samples of merchandise, the hotel cannot be held responsible unless the commercial traveler has informed the hotel staff that he has the samples, and has also informed the hotel staff of the value of the samples. The guest must also get written acknowledgement that the hotel has been informed of the samples and their value. The maximum liability of the hotel, for loss or damage to merchandise samples is $200, unless the guest has entered into a written agreement with the hotel proprietor, stating that the hotel agrees to be liable for a greater amount.
- To operate a finance company in the state of Kentucky, you need to have a license, obtained from the state, if you intend to make loans of $15,000 or more, at legally permitted rates of interest. Section 286.4-420 states that you must also obtain a license if you intend to make loans of less than $15,000 and make a charge for granting the loan, that would not usually be permitted.
Section 286.4-460 of the law states that finance business licenses must include the name of the license holder, including all the partners if the business is a partnership, plus the address of the office where the business is located. The license must be displayed in the business location, and if the business relocates to a new address, it must inform the commissioner responsible for finance business licenses if the new address is in the same county. The commissioner can endorse the existing license with the new address. If you relocate your business to another county within the state, you have to apply for a new license. - When a business incorporates in the state of Kentucky, such as when someone forms a limited liability company, the business owners must draw up articles of association, defining the nature of the business. According to section 271B.2-020 of the Kentucky Revised Statutes, certain information must be included in the articles. Then name of the corporation must be included, along with the number of shares that the corporation can issue. The mailing address, which must be in the form of a street address, of the corporation's registered office must be included, along with the name of the corporation's registered agent at that address. If the corporation's principal business office is different from the registered address, the principal business address must be included. Finally, the articles must include the names and mailing addresses of every person involved in incorporating the business.
